Terms and Conditions

In-Languages is a trading name for InTuition Languages, hereinafter called In-Languages.

Your Course Contract

When you receive your confirmation invoice from In Languages Ltd a contract is made between you and ourselves. Both parties then have commitments towards each other. Our commitment to you is to provide you with the Study Trip you have booked and your commitment is to pay for that holiday. These commitments are clearly set out below Please read these conditions carefully. Completing your booking on line means that you have accepted the terms of this code under which the holiday contract is made. In-Languages Ltd, hereinafter called In-Languages, organise and act as agents between students and Language schools represented.

The "Student" means a person or persons who have signed the booking form for such a language course. Where a booking is made for more than one student the body or organisation making the booking will be regarded as the student.

The company honestly believes that all statements made in its brochure, website or publicity documents prepared or published by In Languages on behalf of students are correct. In Languages shall not be liable for any inaccuracy, errors or omissions of any brochures. We are dependent on the information supplied to us by our language centres, who are at liberty to change the courses and types of accommodation they provide. The courses offered are the responsibility of the individual institutions and whilst In-Languages have taken every step to ensure the quality of the courses, they cannot accept responsibility for the course or the schools. If you have a complaint about the course or accommodation, you should discuss it with the course director and/or accommodation officer at the school you are attending in order to resolve the matter as quickly as possible. Further complaints must be received in writing by In-Languages within 7 working days from the end of the course.

Payment for your holiday

Your completed booking form must be sent to us accompanied by the appropriate deposit. CREDIT CARD PAYMENTS FOR DEPOSITS AND BALANCES WILL INCUR A 1.5% CHARGE (5% for AMEX). This deposit is your only commitment to us until the final payment is due at the date indicated on your confirmation/invoice. You MUST pay for your holiday at least eight weeks before departure unless stipulated on your confirmation/invoice. If you do not do so, we reserve the right to treat your booking as cancelled, in which case you are liable to cancellation charges of up to IOO%. PLEASE NOTE: if you book your course within eight weeks of departure, full payment is required at the time of booking.

Our prices do not include the cost of travel to and from the course. Course materials, examination fees, airport transfers and the cost of activities and excursions are not included except where specifically stated. Students will not be allowed to start their course unless full payment has been received by In Languages.

If we Change your Booking

The arrangements in this brochure are made many months in advance. Whilst In Languages at all times try to satisfy your requirements it is sometimes necessary to make alterations to your holiday or to effect cancellation due to a variety of reasons. In these circumstances we reserve the right at our discretion to make the necessary changes or cancellations. If a material alteration or cancellation has to be made to your course we will offer you the some course on different dates, or on alternative course of the same standard or a full refund of all money paid to us excluding any amounts claimable under your Insurance Cover.

If it IS necessary to make a material alteration (of significant inconvenience to you) to a course after the date when payment of the balance of the price becomes due (other than reasons such as hostilities, political unrest or other circumstances amounting to force majeure) compensation amounting to £10.00 per person will be credited against your holiday costs. If we how to notify you of a material alteration within 14 days of the departure date [other than for reasons such as hostilities, political unrest or other circumstances amounting to force majeure) you will receive compensation amounting lo £30.00 per person. We do not intend to cancel a course, but if it is necessary to cancel your course before the balance of you holiday becomes due, (for reasons other than hostilities, political unrest or force majeure) a full refund will be paid. Descriptions of activities and excursions which accompany the language courses are for guidance only, unless specifically noted in the confirmation invoice. Some activities may not run at all or may be substituted by other activities. In low season, there may be no activities organised at all.

If you cancel your course

For courses booked 30 days or more before the starting date a non-returnable deposit of £150 is payable immediately on receipt of invoice.

For courses booked within 30 days of the starting date total fees must be paid immediately on receipt of invoice.

Cancellations up to 20 working days before the course starts: Loss of deposit

If written cancellation is received between 10 - 19 working days before the course starts: 50 % of the total course plus £25 booking fee.

Cancellations within 10 working days of course start: 100% of the total course fee plus £25 booking fee.

The cancellation fees detailed above will apply to all courses which are not cancelled by written communication with In Languages Ltd. within the period stipulated. Fees are not reimbursed if the student arrives late or departs before the end of the course.

If we cancel your holiday

We reserve the right in any circumstances to cancel your holiday. Please Note:- Each group course is subject to a minimum number of students in order for it to operate. Full details are available on request. In the unlikely event of this being necessary we will offer you an alternative course or full refund of all monies paid to us.

Dates of Arrival and Departure / Local holidays

The dates indicated on our confirmation letter are arrival and departure dates (ie Sunday before the start of the course and Saturday after the end of the course). The days of arrival and departure stand for a single day i.e. arrive in the afternoon and depart before midday. We state local and national holidays when applicable. They are subject to change beyond our control. No refund will be given for lessons missed due to public holidays falling on dates not given by In Languages. There will be no classes on these days and no refund of fees for lessons missed, unless specified.

Activities and excursions

Descriptions of activities and excursions which accompany the language courses are for guidance only, unless specifically noted in the confirmation invoice. Some activities may not run at all or may be substituted by other activities. In low season, there may be no activities organised at all.

Students and people accompanying students are expected to behave in a generally courteous and polite manner. The illegal use of drugs or rude or inconsiderate behaviour, alcohol abuse, or alcoholic consumption by minors, is not considered acceptable. In Languages reserve the right to refuse to serve and/or terminate the participation in the course. The return trip will be at the expense of the student.

Insurance

All course participants must obtain their own personal insurance against cancellation, accident, illness, lack of punctuality or loss of property. Some of our centres may ask for insurance attestation. Any costs, damages or other charges arising from cancellation or curtailment due to a student's failure to be appropriately insured shall be the sole responsibility of the student. No monies can be refunded for any reason.

Liability

In Languages only acts as agent between its students and language centres. Under no circumstances can In Languages be held responsible for any injury, damage loss, delay or accident which may happen during the student's stay with the host family or on the premises of the language centre as a result of activities they take part in during their stay, or whilst travelling to and from the student's home. It is an explicit condition of enrolment that students accept full financial responsibility for any damage caused by them to the host family or language centres property during the course. In Languages reserves the right to vary or cancel courses without prior notice and have the ultimate decision on where the student stays.

In-Languages are not responsible for lessons lost through Acts of Nature: earthquakes, flood, hurricane or other acts of nature. Lessons lost as a result of such acts of nature will not be made up or refunds given. By attending our course you agree to abide by our terms and conditions. Terms and Conditions for Groups:

Definitions:

"The Company" is defined as In Languages Limited, hereafter called In Languages.

"The Client" is defined as the school, college or university, or relevant (educational) institution booking services of In Languages.

"The Group" is defined as participants on the tour organised on behalf of the client.

"The Group Leader/Organiser" is the person arranging the tour on behalf of the Client. Any reference to the Group or Group Leader/Organiser does not affect the relationship between the Company and the client. The person who signs the Booking Form does so on behalf of the Client and binds the Client to these conditions.

Group Course Booking Procedures

Once the Group's requirements have been agreed, the Group Organiser will be sent a quotation detailing the tour price for the services requested. We require a completed booking form and deposit before we can confirm the Group's travel arrangements.

The booking form should be accompanied by the appropriate deposit - £150 per person - and where appropriate the relevant insurance premium. Subject to availability and to our Terms and Conditions of Booking, the final invoice is due for payment six weeks prior to departure.

A contract exists between the Client and the Company once a booking form has been received, checked and accepted for availability of the Group's chosen accommodation and to the terms of these Conditions of Booking, and an invoice issued along with a Client booking confirmation/invoice due for payment six weeks before departure. Should full payment not be made by the due date, the Company reserves the right to cancel the booking, in such case the deposit will be forfeited.

Payment, Invoicing and VAT

Payment is due on the date indicated on the invoice. Receipts will be issued to assist in the Group Leaders accounting. The initial deposit is the clients only commitment to In Languages until the final payment is due. Credit card payments for deposits and balances will incur a 1.5% charge (5% for AMEX). Students will not be allowed to start their course unless full payment has been received by In Languages.

Some suppliers (especially hotels) request pre-payments over and above the tour deposits. This is beyond our control and, whist every effort is made to avoid this, it may be necessary for the Group to make additional payments in order to keep the booking.

As part of the Tour Operators Margin VAT Scheme In Languages does not pay VAT at the standard rate of 17.5% but on our margin only. Our price quoted includes VAT costed on this basis and we are not permitted to show it as a separate amount. Correspondingly, our clients are not entitled to claim back VAT at 17.5%.

Price Guarantee

When the Group has booked the tour and paid the deposit, or full amount if the Group books within six weeks of departure, the price of the tour will be confirmed on the Client's invoice and will not be subject to changes or surcharges unless the Group Leader elects to change the confirmed booking or the number in the group changes. Each group course is subject to a minimum number of students in order for it to operate.

Cancellation Policy:

If We Cancel A Tour

The Company reserves the right in any circumstances to cancel the Client's tour. In this event we will return all monies paid by the Client to us within 14 days. If the Client cancels a Tour

Should the Client or any member of the Group wish to Cancel the confirmed booking, or any part of it, the Group must do so in writing to In Languages. These instructions will only be valid if signed by the person who originally signed the Booking Form for and on behalf of the Client.

The following charges will apply from the date on which we receive written cancellation instructions.

Cancellation Charges

Up to 8 weeks prior Loss of Deposit

Up to 6 weeks prior 25% of total price

Up to 4 weeks prior 50% of total price

Up to 2 weeks prior 100% of total price

The percentages expressed are of the full tour price and exclude any Insurance Premium.

N.B . It is the client's responsibility to ensure that parents and/or guardians are also aware of in languages' booking conditions and cancellation policy.

If The Client alters the booking specification

Should it be necessary for the Client to alter the tour arrangements with us after the issue of the final invoice, an amendment fee of £25 per person will be levied plus any additional tour costs levied by suppliers. Should these alterations involve a cancellation by any member of the Group, cancellation charges will be levied in accordance with our cancellation policy.

Any alteration or abandonment of travel or hotel accommodation or course after the Group has commenced the tour will be in breach of the contract and will not be accepted as any basis of claim against In Languages and no refunds will be made.

Minimum Numbers for a group Tour

Our quotations are based upon a minimum number of paying passengers. Upon receipt of your completed Booking Form and deposits, the relevant price will be applied as per the quotation according to the number of full paying passengers.

Should a member of the Group withdraw from the tour after deposits have been received, the Group may be given a new price based on the actual number of travelling passengers. In this instance no deposits can be returned for those passengers who withdraw. The free place ratio may also be affected and we will advise the Group Leader/Organiser of any repercussions.

Brochure Accuracy

In Languages shall not be liable for any inaccuracy, errors or omissions of any brochures. We are dependent on the information supplied to us by our language centres, who are at liberty to change the courses and types of accommodation they provide. These changes are beyond our control, however, wherever possible we will advise the Group of such changes at the time of the initial enquiry.

Complaints Procedure for the Group Leader/Organiser

If you have a complaint about the course or accommodation, you should discuss it with the course director and/or accommodation officer at the language school you are attending in order to resolve the matter as quickly as possible. Should they not be able to do so and the matter is serious, please notify our office. If the Group Leader/Organiser fails to follow this procedure we cannot accept responsibility, as we will have been deprived of the opportunity to investigate and rectify the problem. The Group Leader/Organiser must ensure that we receive written notice of any claim or dispute arising out of this contract within 7 days of the date on which the tour ended.

In the unlikely event that a tour has been allowed to take place in the absence of full pre-payment having been received, and a complaint is subsequently made, we reserve the right not to respond to the complaint until all monies owed to us are paid.

Passports, Visas and Health

It is the responsibility of the Group Leader/Organiser to ensure the completion of all Passports, Visa, Health or any other travel formalities whatsoever and to ensure that all members of the Group also comply. Please speak to a doctor about any inoculations or vaccinations, which may be required.

Insurance

Travel

In accordance with ATOL regulations, we are obliged to inform the Group that In Languages does not act as principal in provision of air transport. All flights will be charged, at cost, separately from the rest of the tour. The Company will always refer to the ATOL bonded agency used in the quotation, quoting their ATOL number.

The conditions of carriage imposed by all carriers shall be deemed to have been accepted by the Client and are available upon request from the carrier.

Civil Aviation Authority regulations allow airlines to change scheduled/charter flight times without prior notice. We cannot be held responsible for such changes.

Liability
